- The room in Catalonia is a rental dwelling: Llei 11/025 (effective from 01.01.2026) explicitly states that the division of the apartment into rooms does not change the rules of the rental of the dwelling. [1].
- In the mercat residual zone, which includes Barcelona, the rent payments under simultaneous contracts for one dwelling cannot exceed the maximum for the entire apartment [1][4].
- If you rent a room from the tenant, he needs the owner's written consent for the sublease, the sublease price is not higher than the principal lease price, and your right ends with his contract. [2].
- Under LAU, the tenant of the apartment is entitled to move within six months, with 30 days' notice, and the deposit (fianza en metálico) is legally equal to one month's lease [2].
- If the contract does not state that it is temporary, it is considered that he is a permanent resident. [1].
How does the room contract differ from the apartment contract?
Under Llei 11/025, which amended the Law of Catalonia on the Right to Housing Llei 18/2007, the rental of a room is a contract whereby the owner grants the tenant exclusive right to the room and the right to use common premises for payment. The Law adds two conditions: the area per person and the limit of the number of tenants must not violate the rules of cédula de habeaslid (deputy certificates) and the division of the accommodation into rooms does not cancel. Rent regulations [1].
The apartment contract is entirely regulated by LAU (Ley 29/1994 on urban rentals), and the Catalan legislature has a room contract that is considered a rental of housing, but as this regime is combined with the federal LAU regime by duration and extension, we have not found in the official explanations.
What changes if the room isn't rented out by the owner?
Article 8 LAU allows only part of the dwelling to be sub-rented and only with the prior written consent of the lessor; the sub-rent price may not exceed the price of the main lease and the sub-rentor ’s right shall cease when the right of the main lessee ceases to exist [2]Substitution without the owner ’s consent is also included in the list of reasons why the owner may terminate the underlying contract [2].
Before paying, ask for written consent or contract with the owner.
What's to compare: the whole apartment or the room?
| What | The whole apartment | Room by the owner | The main tenant has the room. |
|---|---|---|---|
| Who is party to the contract | Owner | Owner | Main tenant, you need owner's consent. [2] |
| Price cap in Barcelona | Zona tensionada rules: previous rent or index [5] | The room size is no higher than the maximum for the whole apartment. [1] | Not above the price of the main lease [2] |
| Duration | Minimum 5 years with extension (7 if owner of a legal person) [2] | We didn't find the LAU ratio in the explanation. | Depends on the main contract [2] |
| Bail | One month rent [2] | Catalonia Law refers to rental of housing, details | Please specify from the main tenant and in the contract. |
Barcelona is a member of the list of municipalities of the zone of Tenssionado under resolution TER/800/2024 [4]I. Limite is valid for the period of operation of declaración: Generalitat reports that it is issued for three years and is renewed annually [5].
What rules protect the tenant?
The LAU period is free, but if it is shorter than 5 years (7 years if the lessor is a jurist), the contract shall be extended annually to that minimum if the lessee does not fail 30 days before the end of the contract. [2]The tenant has the right to leave after 6 months with a notification for 30 days, and the contract can provide compensation for early exit <x id="569" if the renter can not return the money to the landlord and the landlord. [2]The bond (fianza en metálico) is equal to one month ’s lease, the additional guarantee under the contract of up to five years is not more than two monthly payments, and the lessor pays the agency ’s costs and the contract is paid. [2].
In the tensionado areas, the new lease cannot exceed the last rent in five years with indexation. [5]. The landlord must deposit the pledge with Incasòl two months after signing [6].
What do you choose at the start?
There is no universal answer, and we have no official statistics on the prices of rooms. For the Generalitat apartments, the average rental rate for the first quarter of 2026 was 1,137.35 a month. [7].
If you need a dwelling for a few months, consider rule Llei 11/025: the temporary contract requires the reason (work, study, waiting) and the confirmation. Without the stated purpose, the presumption of permanent residence applies. [1]. Incasòl from 01.01.2026 asks to attach the goal document to temporary contracts [6]Follow BOE: The rates for temporary leases and IVA changed in October 2026.
