Larga duración in Spain (LD): what are the two different status

The Larga Duración in Spain is an indefinite residence permit, called the MCJ in Russian texts. Two species: national and larga Duración-UE; both have five years of basic terms, but UE requires funds and insurance and gives way to other EU countries according to their rules.

Larga Duración in Spain: two statuses under the word "JMC"

In Russian-language texts, "MJ" usually means residencia de larga Duración. Article 182 of the Reglamento (Real Decreto 1155/2024) defines national status as the permit to live and work in Spain indefinitely under the same conditions as Spanish citizens. Practical conclusion: The national map does not automatically allow for the right to move and work in any EU country: each country applies its own rules and the right to mobility is linked to UE. Which of the two statuses will issue an anicina, if you fit both, does not say in the text of Reglamento, it needs to be specified before the application. [4]The Ministry does not specify the period to which IPREM interest is assigned at UE.

How to count five years and permissible absences

Years of legal residence with a residence permit are considered as not to be in violation of the absence for up to six consecutive months if the amount of the residence is not more than ten months; if there is no work permit, the amount is up to eighteen months; neither is the absence interrupted for a valid force majeure, where the body gives the assessment, nor the employment contract work of the NPOs abroad (art. 183.2). How to put it on larga duración and when

Application is filed on EX-11 form in the region of your residence, either directly or electronically through Mercury; from abroad through the consulate [3][2]The following is the order: Modelo 790, code 052, paragraph 2.6. When electronically delivered via Mercury, it is paid at the time of delivery (Orden PJC/617/025, article 2.3); 10 working days and 15 days for the shipment of copies of the NRC are for the direct delivery (articles 2.5 and 2.2) [2][3][5].

  • When. If you have already fulfilled the conditions of the valid permit, you are not subject to the extension of the old permit (arts. 177.2 and 184.2) so make sure that it does not end while the case is being considered. [1][2].
  • Documents. Copy of passport, fee receipt, certificate of non-judiciality from countries of residence over the past five years, special grounds documents, and, for the previous period of residence, certificate of schooling of minor children. [1][2][3].

Foreign documents shall be submitted with apostille or legalization and with a translation of the jury: apostille and legalization. Oficina may refuse if it considers that you are threatening public order or security (Articles 177.5 and 184.5) [1].

TIE card after larga duración

The first card replacement is required five years later, then every five years until the owner reaches thirty and after thirty every ten years. How to keep status and what to do if you lose status

Article 201 lists the reasons for termination: fraud, expulsion, conviction under certain articles of the Criminal Code, absence in EU territory for 12 consecutive months and receipt of larga Duración-UE in another Member State [1]There is another one for UE: the absence in Spain for six years, although the Dirección General may not cease status on a reasoned basis [1]For UE owners after Blue Card, the time frame is longer: 24 months outside the EU [1].

For UE, these are terminations due to absence from the EU or receipt of UE in another country, and absence in Spain for more than six years. For national status: the same two terminations and return after the deadline of the obligation not to return. Application is made in person, with UE required confirmation of funds and insurance, the decision is made within three months (if no reply is received, it is submitted in person, if the UE requires confirmation of funds and insurance, the decision is made within three months. Typical Errors

  • They count five years from NIE. You must count years of legal residence with permits [1].
  • They're putting up different regimes without checking. The school and temporary status are not treated equally [1].
  • National status and UE are being sought. Only UE has a right to the Directive [1][3].
  • They don't look at the amount of absences. Six months in a row is permissible, but the amount for five years is limited to ten months. [1].
  • They are submitted without background or documentation on funds and insurance for UE. Package considered incomplete [3].
  • They're counting the card and status as one. The delayed plastic doesn't change the status, but it can't be ignored. [1].
  • They're leaving for a long time without a plan. Twelve months outside the EU are being terminated [1].
