  • Ministry of Foreign Affairs of Spain: the instruments of the States parties to the Convention do not legalize, apostille replaces legalization [2].

  • In Russia, the Apostilles place eight groups of bodies, such as the Ministry of Internal Affairs, on criminal record and the civil registry on certificates, the Ministry of Justice on other official documents [3].
  • UGE: documents are not translated into Spanish by a juror, and private documents are sufficient without apostille [5].

What is apostille and is it necessary for Russian documents?

[1].

So, for the public Russian documents you submit to the Spanish department, consular legalization is not required: enough apostille. UGE confirms for its statements: public documents of foreign authorities come legal or apostilles. [5].

Electronic documents and exceptions

The Spanish Ministry of Foreign Affairs ’ legal order page states that originals or certified copies with hand-written signature are legalized, electronic signatures are not recognized and photocopies are not legalized [2]This is about diplomatic legalization, not just about the apostille, and we haven't found an official answer, as Spain does with Russian certificates with electronic signature from personal offices, except that the exchange of notes from 1984 (canje de noteas with the USSR) exempts from legalization of the Registro Civil certificate between Spain and Russia. [2]As the consulate applies this to your package, we need to clarify.

What we don't know

Frequent issues

Do consular legalization of Russian documents for Spain be required?
There are no public documents: Russia and Spain are parties to the 1961 Hague Convention, so there is enough apostille to replace the consular legalization chain, except for diplomatic and consular documents, which are still legalized. [1][2].
Do you need an apostille for a certificate of indignity from Russia for a DNV?
The Spanish Consulate in Moscow clearly indicates that Russian certificates of non-judiciality are required for a telework visa with apostille, and in Russia, it puts it on the Russian Ministry of Internal Affairs for criminal record and absence. After apostol, the certificate is translated by the juror into Spanish. [3][6].
Who's putting apostille on a Russian diploma?
The Apostilles of Russian diplomas and documents on education are placed by the authority of the constituent entity of the Russian Federation, which confirms such documents. The distribution of powers between the Ministry of Internal Affairs, the Ministry of Justice, the Rosarchiv, the civil registry and regional bodies is set out in Government Decision No. 479 of 30 May 2016. [3][4].
Should I put the apostille on the employer's letter?
UGE requires apostille or legalization only for public documents of foreign authorities, and the rest of the documents are sufficient for translation by the juror. The employer ’s letter, contract and account sheets refer to private documents, so they need to be translated without apostille. How to refer to a bank ’s public certificate or a register statement does not specify UGE [5].
Did Spain accept Russian documents with electronic signatures?
The Spanish Ministry of Foreign Affairs has not found a formal answer. The Spanish Ministry has written that when legalizing electronic signatures, they do not recognize and legalize originals or certified copies with a handwritten signature, but this is a separate procedure, not apostille. As the consulate and UGE refer to e-signature certificates from personal offices, they should be asked in writing before ordering apostille. [2].
Is there a period of validity for the Apostille?
The Apostille itself has no validity: the Spanish Ministry of Foreign Affairs writes that the legalisation of the document does not have a legal period, but it does not extend the document itself. It is therefore important to update the original reference. For inquiries, such as non-judicial evidence, it is requested by a list of consulates or UGEs, and we have not found a single time limit for all procedures. Check the demand for your own filing.
