Remote work

Letter from the nomad visa employer: model and contents

The employer's letter for the Nomad visa must contain the employee's profile and functions, a direct application for a remote job, euro payment and a minimum of three months' service, and a list of requirements and a sample of the text with the data passes for your company.

Information material, not individual legal opinion: Prepared using IE; checked by a subject matter specialist before publication has not yet been completed; conditions apply to a particular situation and may change.
Short
  • UGE requests the carta de la empres extrandjera: profile and core functions, direct declaration of remote work, euro payment and other conditions [1].
  • Moscow Consulate requests a company's certificado: a minimum of three months' service and a clear permit to work remotely; for self-employed persons, the length of the relationship and the conditions [2].
  • The letter indicates gross: UGE calculates amounts before taxes and contributions [1]For the applicant ’s threshold, this is 2,849 me a month.
  • The letter does not replace the company's register of discharge (activity not less than a year) and proof of income [1][2].
  • The sample below gives the structure of the sub-sections with the company data passes. This is not the official form: we did not find the completed model of the agency.

What must be in the employer's letter for the nomad's visa?

The official documents refer to the letter in different ways: UGE writes "carta de la empres extrandjera", consulate "certificado de la impresa". [1][2].

The functions should be such that they can be performed in an exclusively remote manner: UGE explains that this means that work does not require close-to-face monitoring of production, staff, client visits and similar [3]I. Letter does not replace an entry from the company ’s business register for less than a year and proof of income [1][2].

How is the letter for the hired man different from the paper for the freelancer?

The employee (relacion laboral) requires seniority, permission to work remotely and conditions of payment. For self-employed, the consulate requests certificados to be subject to contract limitations (at least three months) and to terms and conditions under which the distance work will be performed. [2]; UGE calls this case a contrato mercantil [3]The existence of an employment relationship does not prove professional, and vice versa. [1]The freelancer will therefore be entitled to a letter from the employer plus the contract itself, and the owners of the company (autónomo societario) are deemed to be implied, but the rest of the letter is required. Frequent issues

What's the employer's letter for UGE?
UGE calls it "carta de la empresa extranjera", the consulate of "certificado de la empresa". [1][2]
Is there an official model of the employer's letter for the Nomad visa?
The UGE and the consulate documents we read do not have a sample: only a list of contents is given. The model in the article shows the structure of the paragraphs, not the official form or form. The data is in the company, and before you submit the text, you should show the lawyer, especially the phrases on social insurance and the absence of a branch office in Spain. [1][2]
Should the letter be notarized or apostilled?
The UGE apostille requires foreign public documents, the letter from the private company is not relevant to them and the extract from the register is valid. Notary assurance of the letter is not listed in the documents. Translation to Spanish is required: for UGE sufficient juror translation, the consulate requests the translation of all foreign-language documentation. [1][2]
What kind of experience does an employer's letter require?
The relationship with the company must last at least three months on the date of the application (article 74 ter Ley 14/2013). The letter with the date of commencement confirms this, but the contract is also attached. If the deadline is shorter, it is too early to "calculate" the relationship after the submission. [1][2][4]
Should we indicate the salary in euros if paid in rubles?
UGE asks for a payment in euros. What rate of recalculation is the agency takes, does not say: state the rate and date of the recalculation in the explanatory letter and save the value of the exchange; the amount in the letter must be the same as the contract and the account sheets; otherwise, the request for documents will come. [1]
What if the employer doesn't want to write about the remote job from Spain?
UGE and the consulate call it a mandatory letter to work remotely from Spain. If the employer is not prepared to give it, the letter without this phrase does not close the request. The situation should be discussed with the lawyer before the submission, not after a request from the agency. [1][2]
