- You can buy it, but you need NIE. Ajuntament de Barcelona calls it a legal requirement for the purchase of housing and recommends that a bank account be held in advance [1]We have found no general prohibition on the purchase of foreigners in sources. [2].
- You can't buy a residence permit. The articles on the investment visa (Golden Visa) in Ley 14/2013 have been offline since 3 April 2025. [3].
- Order: NIE and account, object and note reference, deposit contract (arras), notary escritura, model 600 tax for a month, register entry [1][4].
- Tax in Catalonia: The ITP pays 10% for secondary housing at a price of 600,000 y, the rate rises to 13%. [4][5][6].
- Notary identifies the parties and can verify the origin of the money on Ley.10/2010. If a non-resident buys one object at a cost of 500,000 I am, the D-2A investment declaration is filed within one month. [7][8][9].
- If the seller is a non-residentThe buyer withholds 3% of the price and contributes them to the seller’s tax bill (Article 25.2 TRLIRNR) [10].
Can a foreigner buy a property in Catalonia without a residence permit?
You can buy a residence permit or a residence permit: you need an alien identification number (NIE), which Ajuntament de Barcelona calls a legal demand for purchase, and usually a bank account for payment. This rule has three reservations that are not widely written.
First, restricted areas. 8/1975 on defence zones allows the identification of areas where foreigners need military authorization to purchase real estate; the list of zones is established by government decree. [2]We didn't find that in the city apartment in Barcelona, but the address is still being checked by a notary and a lawyer, and we haven't opened a full list of areas.
Second: The right of the upper-ranking ransom Generalitat. Ley 11/2025 expanded the cases where Catalonia authorities can exercise the right to tanteo y retracto: in selling housing in a tense market area, if it is owned by a major legal owner from the registry, as well as in transferring housing from an administrative or judicial auction [6]II. New developments in the first year following the cédula de habeaslidad are excluded [6]Ask the notary if your object is in the line.
Third: Real estate investments do not grant residence permits. Articles 63 and 64 Ley 14/2013 on the investment visa have been devoid of maintenance since 3 April 2025. [3]III. The grounds for migration are selected separately, as described in the article on the closed Golden Visa.
Step-by-step purchase order
- Set your status and budget. Taxes and accounts depend on whether you're resident or not by tax rules. on Resident and Non-resident TaxesIf you need a mortgage, the bank will evaluate the loaner according to its rules: Mortgage to non-resident.
- Get a NIE and open the account. NIE needs as an identifier for the bidder [1][11].
- Check the target and the seller. Order a note simple, ask cédula de habitatidad, energy efficiency certificate, debt data to the community of owners. The documents that the seller is obliged to hand over are listed on the Generalitat website. [12][20].
- Sign the deposit agreement. It records the price, the period of time to the notary, the terms of the refusal and the consequences. note and arras.
- Select a notary and sign escritura pública. Buyer is entitled to choose notary himself [20]The notary identifies the parties, checks the credentials and the way the payment is paid, pay as he recommends: transfer from your account to the seller's account.
- Pay the tax. Automatic tax not written off: buyer himself applies the 600 model to Agéncia Tributària de Catalunya and pays within one month of the date of the transaction [13]It's usually assigned to a notary, a guest or a lawyer.
- Register the right. Registration in Registro de la Propiedad protects the buyer from third parties: titles not entered in the registry do not harm third parties (article 32 of Ley Hipotecaria) [14].

Check before deposit
The deposit ties you to a transaction, so the checks are done before it. First, the note simple from Registro de la Propiedad. It shows the owner, the object and the limitations, but is informative and reflects the moment of issue. [15]. Second: the documents that, according to the rules of Catalonia, the seller is obliged to hand over to the buyer: cédula de habitabilidad, certificate and label of energy efficiency, plans, and for a new building warranties, including ten-year insurance, without which a new house will not be entered in the register [12].
Third, information from the seller and agent: before any sum is paid, you must be given the identification of the dwelling with a useful area, the total price with taxes, the terms of sale and the penalties for the violation, and any amount paid confirms the document. [20].
Fourth, check the debts through the community of owners and IBI. They are not visible from the notea simple, and they are requested from the seller and the administrator of the house. For documents from the mandatory list (plans, cédula, notea registration, community charter, energy efficiency certificate), Agencia Catalana del Consum indicates that the buyer does not pay for them. [20].
Notary, origin of money and investment declaration
Spanish notaries are among those who are obliged to apply Ley.10/2010 on countering money-laundering: they identify each participant by document, identify the beneficial owner and monitor transactions, including the origin of the funds (arts. 3, 4 and 6) [9]The non-resident should collect bank statements, a contract to sell the former property or other documents on the source of the funds in advance, and the particular documents requested by the notary depend on the bank and the risk of the transaction.
A separate document for foreign investors: a declaration on investment in Registro de Inversions Extraios. Purchase of real estate in Spain by a non-resident is subject to a declaration if the price of one facility exceeds 500,000 y. The threshold is applied separately to each facility. [7]If a Spanish notary was involved, the date is the date of the notary ’s formalization, and a copy of the document in Registro is handed over to Consejo General del Notariado on request by Registro [8]If money comes from jurisdiction that Spain considers to be non-cooperative, the declaration is required at any amount. [7].
It remains unclear how these rules apply to a man with Spanish TIE or DNV who became a tax resident: in the public domain, we did not find this, ask a lawyer.
Taxes and expenses of the buyer in Catalonia
What you pay depends on the seller and type of dwelling. If you sell a private person, ITP tax; if you sell a new developer and a new housing, IVA plus AJD [4]AEAT ’s operations qualification helps to define the mode [4].

The lower rates (5%, 4% and 3%) are for the purchase of a single dwelling for certain categories, such as young people under 35 (with limited income) or large families, and rural municipalities. [5]The tax base is the highest of the three values, i.e. price, claimed value and official reference value from the cadastre. [17]The price reduction is not working.
Other costs: notary and register, which count by state arena, and contract gendarme [16]If you take a mortgage, the mortgage expense is notarized by the bank and the mortgage is registered, the loanor pays the valuation (article 14 of Ley 5/2019) [18]I. The tax on the increase in the value of land (plusvalía civil) is paid by the seller unless otherwise agreed by the parties [16]But if the seller of a non-resident physical person is named as "subsidized taxpayers" on the table (Art. 106.2 TRLRHL) and is obliged to retain 3% of the price and to pay it to the tax (Art. 25.2 TRLIRNR) [10][19]Talk to the lawyer before signing the treaty.
Typical Non-resident Errors
- Pays up the deposit until the note is checked and the object's documents are checked.
- The old ITP rate is used: until June 26, 2025, 10% were in business as a dealer up to 1,000,000 I, now the threshold of 600,000 I. [5].
- They think the purchase gives you a residence permit and they make visa plans in a bought apartment. [3].
- They don't know if the non-resident sells the apartment: then the buyer has to hold 3%. [10].
- We rely on the agent's oral information about payments to the community and IBI instead of the certificates.
- The tax base is taken at the maximum of the price, the declared value and the reference value [17].
- Not choosing notary himself, although Agéncia Catalana del Consum emphasizes this right of buyer [20].
After purchase: What to Do to a non-resident
After escritura, you need to register, change IBI and community data, connect services. Non-resident rent tax; for non-use housing, separate rules and rates are available on the AEAT website. If you move later and become a resident, the rules will change. Registration at home (padrón) is related to real residence rather than possession: Empadronamiento in Barcelona.
