How long UGE is considering DNV applications: 20 days and longer

UGE must decide on the DNV application within 20 days of the electronic application, which is generally the working days. No solution in time: the application is considered approved (silencia positivo). The real path is longer.

What is the review time for DNV?

Maximum time limit: twenty days from the electronic application to the authority that makes it. This is stated in article 76 Ley 14/2013. Requests for teletrabajo de carácter international (DNV, permission to reside in a digital nomad) are made by the Unidad de Grandes Empreas y Colectivos Estratégicos (UGE, on UGE consulates) and permit is issued by the Dirección General de Migraciones [1].

The word "hábiles" is not included in the article. General rule Ley 39/2015: If the law does not call another account, working days, Saturdays, Sundays and holidays are not counted as working days. [2]So 20 working days, about four calendar weeks.

What is silencia positivo and what does it give?

Silencio administrativo positivo: if the deadline has expired without a decision, the application is considered as approved by law. For Ley 14/2013 permits, this is explicitly stated in article 76. [1]The later decision on Ley 39/2015 can only confirm such silence [2].

What's the deadline, and what's stopping it?

The deadline is from an electronic submission, not the day the case was declared complete. Requerimiento: request for missing documents or clarifications. It may suspend the time between the notification and your response, or if no reply is provided, the time taken to reply. Without reply, you will be considered as having refused the application (desistimiento) [2].

An electronic notice you haven't opened for ten calendar days is considered rejected. [2].

Why is the real cycle longer than 20 days?

Twenty days: ceiling for the organ, not length of the entire journey, which does not include document collection, translations and apostiles before delivery, stoppages due to requerimiento and post-decision card: if permit is to be granted for more than six months, it must be filed on TIE [1].

We have not found official UGE average time statistics. The numbers on blogs are different, we do not report them. Article 23 Ley 39/2015 allows an exceptional and motivated extension of the deadline, no longer than the original one. [2]; whether UGE applies it to DNV, we don't know.

How much does DNV take through the consulate?

Article 75 Ley 14/2013 sets the time limit for the decision on the visa at 10 working days, except in cases of consultation on article 22 of the Visa Code: the time limit for the Code itself is [1]The 20-day rule and the Silencio rule apply to the authorization of UGE, not to the visa.

What if UGE is silent for more than 20 days?

Frequent issues

How many working days does UGE consider a DNV application?
The maximum of twenty days from the electronic submission (article 76 Ley 14/2013). The word "working" does not appear in the article, but according to the general rule Ley 39/2015 days in working hours, i.e. about four calendar weeks, the validity of requerimiento may fall out of the period, so the entire journey is usually longer.
