Law 14/2013: what is this law and what is DNV involved in

What is Ley 14/2013?

Full title: Ley 14/2013, de 27 de septiembre, de apoyo a los enprendedores y su internacionalización. The law was published by Jefatura del Estado, published in BOE No. 233 of 28 September 2013 and in force since 29 September 2013 [1]This is not a "visa law", but many sections on business and export support. Migration standards are collected under "Movilidad international" (Section 2 Título V, Articles 61-76) [1].

What categories regulate Ley 14/2013 for foreigners?

Article 61 lists categories to which the law facilitates entry and stay for economic reasons [1]:

The law does not apply to EU citizens or to those who enjoy equal rights of free movement (art. [1].

Why is Ley 14/2013 referred to in DNV?

Because DNV is not part of the general regime of Reglamento: this category has been added to Ley 14/2013 by Ley 28/2022 (de startups) as articles 74 bis - 74 quinquies [1]. They specify who an international teleworker is, what visas and permits are issued [1].

  1. Article 74 bis: A person works remotely for a company outside Spain; a contract worker can only work for such a company, self-employed person is entitled to work for a Spanish company if this is no more than 20% of his or her total professional activity [1].
  2. Article 74 ter: The company must have been engaged in a real activity for at least a year and its relationship shall last for at least three months [1].
  3. Article 74 quater: a visa for up to one year; a residence permit may be requested within 60 calendar days prior to its completion [1].
  4. Article 74 quinquies: authorization for persons lawfully present in Spain, up to three years, extension for two years [1].
  5. Article 76: Applications are handled by the Unidad de Grandes Empreas y Colectivos Estratégicos (UGE) electronically, decided by the Dirección General de Migracions, the decision period of twenty days, then silence is considered as approval [1][2].

How does Ley 14/2013 differ from Reglamento?

Reglamento (Real Decreto 1155/2024) - General Regulation to Ley Orgánica 4/2000: it is issued as a no lucrativa, employment, self-employment, family reunification, study and arraigo [3]Ley 14/2013 is a special law for certain categories, and where its norms differ from general, special ones apply. Example: the term of the decision under DNV is called by the law itself (twenty days, silence as consent), and in a number of categories of the general regime it is three months [1][3].

What doesn't Ley 14/2013 say?

Article 62 requires "sufficient means", additional regulation 20 directs the authorities to issue instructions with requirements and binds the thresholds to the minimum wage [1]The threshold for one applicant is 2,849 per month for 2026, or 34,188 per year before taxes, as instructed by the authorities [2]C.
