International telework (teletrabajo de carácter international) is a status for a citizen of a country outside the European Union, to whom Spain permits to stay in its territory to work remotely for a company located abroad. What is the definition?
In article 74 bis, four topics to be met simultaneously [1]:
- A third-country national, i.e. not an EU citizen or a person to whom EU law applies [2];
- Work or work, i.e., employment or self-employment;
- Work is done for companies outside Spain;
- The work is conducted exclusively by means of information, telematics and telecommunications.

What does "exceptionally distance work" mean?
The law does not decipher the word "only." FAQ UGE explains it: the function of a post does not require presence on the ground to supervise or manage production, staff control, exit sales and so on. What documents are in place: visa or permit?
The law provides for two ways: a third-country citizen living abroad applies for a visa to the consulate: it operates for up to one year and gives the right to live and work remotely (art. 74 quater) [1]. Anyone who is legally present in Spain or holds such a visa may obtain a residence permit for up to three years, renewable for two years (art. 74 quinquies) [1]. What is not relevant to international teleworking?
If a foreign company has a branch in Spain, the employee is considered to have been transferred within the company (ICT) and the requirements of this category apply.
