Digital Nomad in Spain: residence requirements for remote workers

Spain’s Digital Nomad visa (DNV, teletrabajo de carácter internacional) allows you to live in Spain while working remotely for companies abroad. You need a degree or three years of professional experience, an employment or client relationship of at least three months, gross monthly income from €2,849, health insurance and the appropriate Social Security coverage.

What is Digital Nomad in Spain and who can serve

Digital Nomad (DNV) in Spanish law is called "teletrabajo de carácter international": international telework. Article 74 bis Ley 14/2013 defines this as the right of a third-country citizen to live in Spain and to work or work remotely for companies outside the country, using exclusively computer, telematic and telecommunications means. Any citizen of a third country who is an adult can give, but the EU does not do so. The law separates two models: a worker (you are a hired employee) and a professional (you are self-employed and are under civil law contracts). A hired employee can only work for a company outside Spain. A self-employed person may have Spanish clients but not more than 20% of the total professional activity. [1]III. How much do you earn for DNV and how to count on family

The income threshold is set by the agency ’s instruction and is tied to SMI. For one applicant, this is 20% SMI: 2,849 a month, 34,188 a year before retention. How to get a DNV: step order

The law allows two ways, if you're not in Spain, you apply for a visa at the consulate. If you're already legally in Spain, you apply for a permit at UGE directly. [1].

  1. Check the terms. Diploma or experience, age of company, duration of relationship, income threshold, family status.
  2. Close Segurid Social. For a hired employer, you register in the Spanish system or you get certificado from the country of origin, you need an alta obligation in RETA for self-employed persons. This must be done before you can submit: Digital Nomad and Seguridad Social [2].
  3. Get the papers. Form of application, passport, company letter, diploma or seniority, income confirmation, insurance, transfer and apostille criminal record, duty receipt [2].

  6. Put TIE on. If the permit is valid for more than six months, you must apply for a card. [1].

How many DNVs operate and how they are extended

The DNV visa from the consulate is valid for no more than a year if the job is shorter. 60 days before the visa is terminated, you can apply for permission. Typical Errors in DNV Preparation

  • Confirm net income. UGE estimates gross amounts before taxes and contributions [2].
  • Start with a visa without a Seguridad Social plan. The consulate in Moscow requests confirmation of the company's registration application and your membership. [4].
  • To serve with a recent company. The company needs a year of real activity, and your relationship with you takes three months. [1].
  • Work until the decision to "test mode" is made on no lucrativa. UGE doesn't accept such a long time [2].
  • Wait for tax discounts. The permit does not include an automatic tax treatment.
  • Not to make an apostille for questioning. Criminal record certificates from Russia, Belarus, Armenia and Uzbekistan are accepted by the consulate in Moscow only with apostille, and must be ordered in advance [4].
