- Five years of legal and continuous residence in Spain before the application is lodged. This is a condition for both national status (art. 183 Reglamento) and larga duración-UE (art. 176) [1][3][4].
- Travels do not interrupt continuity unless each is longer than six consecutive months and their amount is five years less than ten months. For work trips, the amount may be up to eighteen months. [1][3].
- The years of study estancia for larga duración-UE are considered to be 50% of the period if you are already in the residence at the time of the application. [1][3][4].
- You can apply within two months of the end of the current permit. [1].
- For DNV, two terms of Ley 14/2013, three years and then two years of extension, are five years in total. [1][5].
PMTCT in Spain: how many years are needed and what status
In Russian-language texts, "MJ" usually refers to residencia de larga Duración: a permit allowing for the residence and work in Spain indefinitely under the same conditions as Spanish citizens. [2][3]The national status (larga Duración national) and the status of larga Duración-UE under Directiva 2003/109/EC are distinguished. [4]The differences between them are addressed in the material larga duración and larga duración-UE.
Basic condition for both: five years of legal and continuous residence in Spain before application is made [1][2]The word "legal" means that it is considered to be years when you had a residence permit or it was valid because of the extension granted.
The status is not equal to the card: the TIE long-term resident plastic card is first updated after five years, then every five years until the owner's thirty-fifth birthday and every ten years after. If you missed the card update, the status does not cease. [1].
Five-year periods
| Period | Is it considered | Norma |
|---|---|---|
| Temporary residence (no lucrativa, work, DNV, family, arraigo) | Yes, as a legal residence. | arts. 183.1 and 176 [1] |
| Extension time to decision | Yes: the authorization remains valid if the application is filed within the time limit | arts. 64, 80, 86 [1] |
| Training estancia | For UE 50%, provided you are served at the residence | art. 176.a [1][4] |
| Training estancia for national status | Article 183 and the reference sheet 49 do not mention | art. 183 [1][3] |
| Living without permission or after delay for more than three months | Not considered lawful | art. 183.1 [1] |
| Leave Spain | Depends on length and amount | art. 183.2 [1] |
Separately on gaps: If there was a period between two permits when the document was not available, it was not legal residence, and the breakup could move the date from which the five years are counted. [1]That's one of the best questions to solve before you file.
Permitted departures: six consecutive months and 10 per cent
The continuity of residence does not affect departures for up to six consecutive months if the total amount is not more than 10 months in five years; for work-related departures, the amount may be up to eighteen months in the same six consecutive periods; for a force majeure mission, documented, the agency evaluates individually; and for work abroad, the continuity and work of a contract with a registered NPO, foundation or association, on cooperation projects [1][3]III. Rules do not apply when the departures have been carried out on an irregular basis [1].
| Five-year situation | Contract | Total | Conclusion on the text of article 183 |
|---|---|---|---|
| Three trips of three months each | up to 6 months | 9 months | Continuing |
| One seven-month trip | more than 6 months. | 7 months | Continuity breached |
| Four trips of three months each | up to 6 months | 12 months | It's a violation if it's not a work trip. |
| Three five-month work trips | up to 6 months | 15 months | Maintained at work limit (up to 18) |
This is an illustration of the rule, not a calculation of the situation. What is "exit for work reasons" for a remote DNV employee, the text does not say, so it is safer for him to be focused on a 10-month limit. Long departures and extension of residence permit.
Prevention: Additional regulation 6 Ley 14/2013 allows for an extension, in the absence of more than six months per year, for visas and permits for investors and employees of companies whose activities abroad are based in Spain but specify: continuity for the PSC or citizenship must still be confirmed [5]Whether this rule is extended to DNV is not stated in the text; the soft rule of five-year extension is not working in any case.
How to count five years by step
- Write down all statuses with resolutions dates: start-up stay, study, no lucrativa, work, DNV extension. Next, set the end dates: one start date is not enough.
- Separate the legal periods from the illegal gaps, and write down the reason and date for each gap.
- Collect the dates of all departures: the dates of departure and return by ticket and stamp, and calculate the longest exit and the amount of departures.
- Identify the type of status. For larga duración-UE, there is an additional need for permanent and regular funds and health insurance, and for the national ministry's reference sheet, no such conditions are specified. [1][3][4].
- See if you need a window delivery before you finish your permit or if you can apply it right away because the condition has already been met. [1].
Years of study are better written as a separate line, "50%", which means that if you apply to UE, these months give half the years of service, if you are in national status, you should make sure that they are taken into account at all.
When to apply to the PJP: two months before or before the end
The application for the MJM shall be filed within two months of the end of the valid permit, and the application shall be renewed until the decision is reached. The same shall be applied within three months of the end, but with the risk of a fine. [1]. Exemption: If you have an existing permit and you already comply with the terms of articles 183 or 176, this restriction shall not apply and the application may be made earlier [1].
You can apply to the state of residence, where you live, with an EX-11 form, a full passport, a fee card and a criminal record from the country of residence over the past five years, if necessary. [1][3][4]The time limit of three months, silence means approval. [1].
PJP after DNV: 3 plus 2
DNV permit for Ley 14/2013 is issued for up to three years, extension for two years [5]. The total is five years of permits that are eligible for permanent residence. You will need to file in the window before the end of the second period, if the conditions are not met before [1][5]Whether the year of the DNV visa is five years old, if you entered through the consulate, we have not established from open sources: this is a matter that needs to be clarified in advance.
For DNV, a separate question is: Remote work often coincides with travel. For the DNV, the exit limit described above is applicable; for the extension of DNV, the minimum period of residence in Ley 14/2013 is not specified. Dissolution: DNV extension after three years.
Typical calculations errors
- Considered from the date of the first NIE or first entry. [1].
- They build up years of different regimes without checking which ones are legal residences, which are not counted as the residence.
- They don't count the totals and they only look at the longest.
- They take the departures of a remote worker for "works" and set a limit of eighteen months without confirmation.
- Forget that the delay in the extension breaks legal residence for more than three months [1].
- They serve a few days before the permit is finished without a copy of the documents.
- TIE long-term resident permits are being issued: these are different things [1].
When Individual Review Is Needed
Individual calculation is needed if history has a study, a change of foundation, a gap between permits, long trips or visa years. It is at these points that the text of Reglamento leaves questions and the decision is taken by the shikina de extrandjería when checking the residence time: it checks on its own initiative your previous periods and requests a criminal record in Spain and a police report. [1].
