Diploma omeology: 15-step scheme

1. Decide if you need a confession at all.

   The recognition of a diploma is not a necessity for all, but it is not necessary to do so if the profession in Spain is not regulated and the employer accepts a foreign diploma as it is and the university itself usually checks the level for admission to the master ’s degree. 2. Select procedure

   Real Decreto 889/2022 divorces procedures by effect. Homologación produces the same effects as Spanish official diploma, including access to regulated profession. Declaración de equivalencia confirms the academic level of Grado or Máster without professional effects. EU citizens with a diploma from the EU country can go through a third way: reconocimiento de civiliciones profesionales under Directive 2005/36/EC (RD 581/2017). The Ministry does not recognize the fact that equivalencia a doctor decides the university.

3. Check your profession in the controlled list

   The list of professions for which Spain needs an official university degree is attached to the RD 889/2022 (art. 8): medical, technical and pedagogical professions: doctors, nurses, pharmacists, architects, engineers of certain professions, teachers; there are special rules for certain professions: according to the Ministry, abogado and procurador homologación are not possible for a foreign legal degree.

4. Collect the documents.

   Article 13 of RD 889/2022 requires a document confirming the identity and citizenship, diploma and academic certificate of the official duration of the programme, subjects, hours or credits of ECTS. For homologación, Spanish is added at or above the level B2 if you are not from a country where Spanish is official: DELE B2, certificate of the official language school, certificate that at least 75% of the programme was in Spanish or prior education Spanish.

5. Put an apostille in the country of extradition

   The diploma and academic certificate are submitted by legalized or apostilles of the Hague Convention; the exception is for documents of the EU, EEA and Switzerland only, and the Apostilles are placed in the country where the diploma is issued; in Russia, these are the executive authorities of the constituent entity of the Russian Federation, by Government Decision No. 1890 of 10 November 23, and can be applied through the State services. In Ukraine, the education documents are issued by the Ministry of Education through the ICN International-Iljiboji Centre. 6. Order an official translation

   RD 889/2022 requires official translation into Spanish for documents issued in non-Spanish, in practice it is a tradección jurada, a translation of a juror appointed by the Spanish Ministry of Foreign Affairs, and an apostille. juror transfer.

7. Pay for the Tasa 107

   The fee for homologación or equivalencia is 166.50 I for Tasa 107, for each procedure separately. You can pay by card or write-off on an electronic application, in the form of a modelo 790-107 in a partner bank or transfer from abroad to the Ministry. Another person can pay if the name and number of the applicant ’s document are included in the payment.

8. Apply for sede electrónica

   The application is only submitted electronically in sede Ministerio de Ciencia, Innovación y Universidades (universidades.sede.gob.es): a separate procedure for homologación and equivalencia. You need not be in Spain. Load scanners with apostille and translation, name the files clearly. Save the registration number.

9. Set the entry: certificate or Cl@ve

   Sign the application and then read the notifications as convenient as possible with certificado digital or Cl@ve. For Cl@ve you need a DNI or NIE and a Spanish mobile number; registration is possible via video identification in the application, via video call, by letter-invitation or by personal contact. 10. Mark the time frame and the rule of silence

    Under article 18.3 of the RD 889/2022, the Ministry must issue and notify the decision within six months of the registration of the application. If no decision is reached, the application may be considered rejected (silencia destimatorio). The deadline is suspended for the time of the reply to the request for documents.

11. Answer the requerimiento

    If the kit is incomplete, the Ministry will send a requerimiento de subsanación. As a general rule, Ley 39/2015 (art. 68.1), 10 days are allowed for correction; RD 889/2022 allows extension in case of objective difficulty.

12. Be Ready for Countervailing Measures

13. Get a decision and a special one.

    The solution is positive, negative or conditional; the homologación is a special one, equivalencia certificado (art. 20 RD 889/2022), and the special effects are the same as the Spanish official diploma throughout Spain. Keep the electronic file and make certified copies.

14. Enter the colegio profesional

    For many regulated professions, the same diploma is not sufficient: under article 3.2 Ley 2/1974 de Colegios Profes, membership in the colegy is compulsory when required by State law; one territorial colegio is sufficient in the place of main practice and it gives the right to work throughout Spain; in Barcelona, this is the coleg of Barcelona or Catalonia in your profession.

15. If refused: recurso or studies in Spain

    The Ministry ’s decision may be referred to the court for a period of one month or immediately to the court of contencioso-administrativo within two months with notice (art. 21 RD 889/2022) If the silence is refused, the reposión may be applied at any time (art. 124 Ley 39/2015).
