Rent an apartment in Barcelona on your own: 15 steps from budget to subscription

You can rent an apartment in Barcelona without an intermediary agency on your side if you know in advance what bail is legal, who pays the agency, what price ceiling is in the tense market area and what to check before signing. Below are 15 steps from budget calculation to Empadronamiento, including for those who do not have a nómina, the Spanish salary certificate.

Whose route is it?

The list is intended for those who rent a dwelling in Barcelona for permanent residence: after moving, changing apartments, before applying for a residence permit where an address and empadronamiento are needed, registration of a residence, especially if you do not have a Spanish employment contract and nomina: owners and agencies ask for it almost always, and it is important to know which replacements are legal.

Rental of apartment in Barcelona: 15-step scheme

  1. Count the budget for the entrance.

    The entry is not only paid for the first month; the law requires a fianza of one month of rent, the owner may request an additional guarantee not exceeding two months, and he may request no more than one month in advance.

  2. Select the area and type of dwelling

    First, you decide whether you want an apartment or a room and what time period, and in Catalonia, the rent for work, study or treatment for a while is subject to the rental rules, and only rest and leave remain special (Ley 11/2025).

  3. Gather the tenant's file.

    A good file saves weeks: the owner chooses who sent it all at once. The file is not legally defined, it's market practice.

  4. If no nómina: propose a legal replacement

    Without nómina, the balance, foreign income, aval bankario (bank guarantee) or non-payment insurance, which the owner normally issues, is facilitated by a cash flow statement, and any form of security in contracts for up to five years is limited to two months, and the law does not allow for an advance to be requested more than one month.

    When you need help, you are asked to pay for six months or a year ahead: this is a condition that is not in line with articles 17 and 36 of LAU, and you will discuss it with a lawyer before the money is transferred.

  5. Search the portals and turn on the notifications.

    Good options go by the day, so watch the ads immediately. There should be an energy efficiency class in the ad: this is a Real Decreto 390/2021 requirement, and its absence is a reason to ask questions.

  6. Dismiss fraud

    Typical scheme: Price is markedly lower than the market, "owner abroad", please transfer the bond before viewing. Pay only after viewing and checking the owner, to an account in his name.

  7. Watch the apartment on the checklist.

    The view test is what is then difficult to prove: humidity, windows, hot water, heating, and metering.

  8. Check the owner by notea simple

    Nota simple, an extract from Registro de la Propiedad, shows the owner and the encumbrances. Whoever surrenders must be the owner or have the right to surrender (trust, contract with the agency).

  9. Check cèdula d'habitilita and energy certificate

    Cèdula d'habitilat, a Catalan document on housing suitability, is required for the transfer of housing to use under article 132 Ley 18/2007. A copy of the energy label is attached to the lease contract and passed to the tenant (Real Decreto 390/2021).

    When assistance is needed: cèdula is not available or is issued for another premises: communal contracts and propiska depend on it.

  10. Check the price with the cap in Catalonia

    Barcelona was declared a tense market area from 16.03.2024 to three years, and in July 2026, Govern extended the first declaration for a year (renewal is pending approval by the Ministry), and in such a zone the new lease cannot exceed the previous lease of the apartment in the last five years, with indexation accounting, and the major owner (five or more facilities) has a reference price index.

    When you need help: the price is above the limit, and the owner says it is "not in effect": check the relevant declaration and your case with the lawyer.

  11. Read the LAU contract

    If the contract is shorter than five years (seven in the case of a Turkish), it is extended annually until 30 days before you refuse to leave. You can move out early in six months with a 30-day notice. Indexing only if it is prescribed once a year and not higher than the CPI; the IRE update guide is published monthly as IRAV.

    When you need help, there are early departure fines, waivers of LAU rights, or a contract in Spanish that you don't fully understand.

  12. Don't pay the agency to process.

    With Ley 12/2023, article 20.1 LAU expressly states that the cost of the Gestción inmobilaria and the contract is borne by the owner. If the agency pays the account to the lessee, ask in writing what service and under which contract.

    When assistance is needed, the commission has already taken over: the return is decided by the claim and then through the consumer authorities or the court.

  13. Bring the fianza and check the deposit

    In Catalonia, the owner is required to enter fianza into INCAS

  14. Form a status report and re-engineer public utilities

    The photo and meter statements act solves disputes about fianza when you leave, light, gas, and water are often left on the owner, then the contract says how you reimburse the expenses.

  15. Stand by and secure the dwelling.

    Anyone living in Spain is required to register in the Padron in their place of residence, which usually requires a valid lease, and ajuntament can request a final lease receipt. The LAU housing insurance does not require it, but the contract may provide for it.

    When you need help: the owner prohibits registration: you need a residence permit and medical permission, you need to get the situation straight before you file.

Typical errors on this route

  • The "bronk" is translated before viewing and checking the owner's name by nota simple.
  • The guarantees are over-limited: fianza plus up to two months of additional guarantee, the rest of the law for contracts under five years is not allowed.
  • The agency is paid for the commission, although it is carried by the owner under article 20.1 of the LAU.
  • They sign a "seasonal" contract for permanent housing and lose protection at a time and price.
  • They don't make up the fortune act and then argue about returning the fianza without proof.
  • They do not check cèdula d'habitilat and then cannot re-engineer utilities.

Frequent issues

Can you rent an apartment in Barcelona without a nómina?
The owner may be offered a statement, a confirmation of income from abroad, aval bancario or an additional guarantee; all the additional guarantee in the contract of up to five years may not exceed two monthly payments, and no advance may be required for more than a month.
How much bail can you ask for on a lease in Catalonia?
Fianza one month of lease (article 36.1 LAU) and additional guarantee not exceeding two months (article 36.5) in contracts up to five years, up to seven years in the lawn. Fianza pays the owner to INCAS .
Who pays the commission to the agency?
The cost of the Gestien inmobilaria and the contract is borne by the owner (article 20.1 LAU, as amended by Ley 12/2023) and the separate service you have ordered under your contract is paid by you.
Can the owner raise the rent in a year?
Only if indexing is recorded in the contract: once a year, on the anniversary date, and not above the CPI. For updating the IREAV index. In the case of a new contract, the limitations of Article 17 LAU apply in the tense market area.
Can you move out early?
Yes, six months after the beginning, warning the owner at least 30 days (article 11 LAU) the contract may provide for compensation: read this paragraph before signing.
Is the lease suitable for empadronamiento?
Yes: The INE instruction on the maintenance of the Padron calls the current rental agreement one of the documents of residence. Ajuntament can check the information in other ways.
